If a person's debt and other liabilities are more than his equity, the debt can be paid or recovered from such equity, or the action related to debt can be initiated to discharge the liability.
(2) Notwithstanding anything contained in sub-section (1), proceedings related to damasahi shall not be initiated in the following cases:-
(a) If a person who has regular income or who is certain to have income in the future proves that he can pay or discharge the loan or other liability for a certain period from his income, or if the creditor is satisfied about such thing,
(b) If the person who is going to be involved in Damasahi requests a period of up to five years from the date of creation of the situation to initiate Damasahi proceedings, to avoid initiating such proceedings or to disclose the debt payment period of the creditor and its source, or
(c) If the creditor does not agree to initiate or cause Damasahi proceedings.
(3) For the purposes of this paragraph, "property" shall mean the property of the concerned person that is immediately existing or that may be acquired or acquired before the completion of the proceedings related to marriage in accordance with this paragraph.
(4) For the purpose of clause (c), "creditor" means a creditor or a group of creditors who have to take a loan of fifty percent or more of the total debt of the person who is going to be married, in case there is more than one creditor.
(5) Pursuant to this paragraph, if a creditor's debt or claim is removed from the property of a person, such person shall be deemed to be in the custody of the creditor.
(6) According to sub-section (3), the court shall send the report of the person involved in damasahi to the Damasahi administration office established for such purpose.
(7) The register according to sub-section (4) shall be updated by the Damasahi Administration Office.
(8) According to sub-section (3), if a person falls under the law of marriage, the debt or liability other than the debt taken by him or the liability to be fulfilled by him, which has been discharged in accordance with this paragraph, shall be paid by him orNo need to complete.
(9) Notwithstanding anything written in sub-section (6), a person shall fulfill the following obligations from the trade, business or business that he starts after becoming a creditor:-
(a) Taxes, fees or duties payable to the Government of Nepal, State Government or local level,
(b) Penalties to be paid as per court orders, amount of fines,
(c) the amount to be paid for misappropriation of the property of a person under his guardianship or custody,
(d) the amount to be paid for the stolen goods,
(e) Amount to be paid for misappropriation of Guthi's property.
(1o) Notwithstanding anything written elsewhere in this section, a person in a marriage may engage in any trade, business or transaction other than the work or action that should not be done in accordance with the law.
